Basically, the Rule of Recognition may, but need not, incorporate moral criteria into the criteria for legal validity. Thus, Positivism seems to have successfully answered or "parried" Dworkin's challenge in his "Model of Rules" paper. I read him -- in Shaprio's paper -- as suggesting that the Rule of Recognition is deficient for the very reason that it cannot capture the sort of considerations that legal principles help to engender.

Whether or not the Rule of Recognition incorporates legal principles misses the point entirely. But that is where the debate seems to have gone, rightly or wrongly. Anyway, anyone with an interest in this sort of thing should procure this book for the Shapiro article alone.
